Orange County Clerk of Courts

The Orange County Clerk of Courts handles all marriage license services in the county. The main office is at the Orange County Courthouse, 425 North Orange Ave., Room 350, Orlando, FL 32801. Phone: (407) 836-2000. Hours run Monday through Friday from 7:30 a.m. to 4:00 p.m. That early start time is a plus for people who need to get things done before work.

Orange County has three branch locations beyond the main courthouse. The Apopka Branch is at 1111 North Rock Springs Rd. The Ocoee Branch sits at 475 Story Rd. The Winter Park Branch is located at 4037 Metric Drive. All four locations handle marriage license applications during the same hours. This spread of offices means most Orange County residents have a clerk location fairly close by.

Both parties must appear in person at the same time. Valid photo ID is required. The Orange County clerk takes cash, money orders, cashier's checks, MasterCard, Visa, Discover, and American Express. A credit card surcharge of $3.50 applies. No personal checks are accepted.

You can also print a paper application and bring it in. Either way, both parties must come to one of the four Orange County clerk offices together to finish the process and pay the fee.

The three-day waiting period is important to understand. It does not start when you fill out the online application. It starts when both parties come to the office and purchase the license in person. Florida residents wait three days after that before they can get married. Taking a premarital course from an approved provider waives the wait and drops the fee from $86 to $61. Non-Florida residents have no waiting period at all. If both parties live outside Florida, they can buy the license and get married the same day in Orange County.

Under Florida Statute 741.04, both parties must sign an affidavit. Anyone 18 or older can apply. A 17-year-old needs parental consent, and the other party cannot be more than two years older. If either person was married before, the exact date the last marriage ended is required. Couples with children born together in Florida must fill out an Affirmation of Children Born in Florida form at the Orange County clerk office.

Fees for Orange County Marriage Records

The marriage license fee in Orange County is $86 without a premarital course. With proof of course completion, it drops to $61. The course must be done within one year of applying, per Florida Statute 741.0305. The clerk charges $3.50 as a credit card surcharge on top of the license fee when paying with a card. Cash and money orders have no surcharge.

Certified copies of Orange County marriage records are available at the clerk office. Pricing follows the standard Florida schedule. The license is valid for 60 days under Section 741.041. After the ceremony, the signed license must be returned to the Orange County clerk within 10 days. The clerk records it and the couple gets a certified copy. Under Section 741.09, the clerk must keep a correct record of all licenses issued.

The state also has Orange County marriage certificates from 1927 forward. The Florida Bureau of Vital Statistics charges $5 for a search and one certified copy. Extra copies cost $4 each. Online orders through VitalChek run $15 plus $7 processing.

Note: Orange County marriage licenses issued before June 6, 1927 are only available from the county clerk, not the state.

Orange County Marriage Ceremony Options

The Orange County Clerk of Courts performs civil marriage ceremonies. The fee is $30. Both parties need a valid Orange County marriage license that is past the waiting period. Under Florida Statute 741.07, several types of officials can perform the ceremony. Ordained ministers, all Florida judges, clerks and their deputies, and Florida notaries public are all authorized.

If you do not want to use the clerk's ceremony, you can have anyone authorized under state law perform it. The ceremony can happen anywhere in Florida with an Orange County marriage license. There is no requirement to get married in Orange County just because your license was issued here. The license works statewide for 60 days.

After the ceremony, the officiant signs the license. It must then go back to the Orange County clerk for recording. Marriage records are public in Florida under Chapter 119. Section 119.07 gives anyone the right to inspect and copy public records. Social Security numbers and certain other details are redacted, but the rest of the marriage record is open.
